Terms of Service - JourneyPic

1. Acceptance of Terms

By downloading, installing, or using JourneyPic ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Use of Service

JourneyPic is a travel documentation application that allows you to record journeys, upload photos, and share your travel experiences. You agree to use the service only for lawful purposes.

3. User Accounts

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account
You must be at least 13 years old to use the App
One person may not maintain more than one account

4. User Content

You retain ownership of all content you upload. By uploading content, you grant JourneyPic a worldwide, non-exclusive, royalty-free, transferable license to use, store, display, reproduce, modify, and distribute your content solely for the purpose of operating and improving the service.

This license includes the right to:

Display your content to other users (based on your privacy settings)
Create thumbnails and optimized versions of your photos
Process your photos through third-party AI services (Google Gemini, Meshy AI) to generate custom 3D character models, AI titles, summaries, and travel book content
Use anonymized data for analytics and service improvement
Back up your content for data protection purposes

This license ends when you delete your content or account, except for content that has been shared with others or used in anonymized form.

4.1 Custom 3D Characters

Custom 3D Characters generated from your photos may contain biometric features (facial geometry, body proportions). Because of the personal nature of this data:

You retain full ownership and control of your Character Models. JourneyPic uses Character Models solely to:

Display them in your personal route videos within JourneyPic
Sync them across your devices via your account

We will NOT:

Use Character Models for marketing or promotional purposes
Share Character Models with other users
Sell, license, or transfer Character Models to third parties
Use Character Models or your photos to train AI models

You can delete Character Models at any time, and we will purge all related data from our servers within 30 days of deletion. Before generating a Character Model, you will be asked for explicit consent to biometric processing.

4.2 Custom 3D Vehicles

You retain ownership of any 3D vehicle models you generate using JourneyPic ("Vehicle Models"). Because Vehicle Models do not contain personal or biometric data, by creating them you grant JourneyPic a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, adapt, distribute, and publicly display your Vehicle Models for purposes including but not limited to:

App demonstrations and onboarding content
Marketing materials and promotional content
Sample galleries within the app
App Store screenshots and previews
Product improvement and quality analysis
Public template libraries (future feature)

We will NOT use Vehicle Models in ways that:

Identify you personally without your consent
Suggest your endorsement of products or services
Are misleading or defamatory

You can revoke this license at any time by deleting the Vehicle Model from your collection. Once deleted, we will cease new uses, though existing copies in published marketing materials may remain.

Content Restrictions

You agree not to upload content that:

Is illegal, harmful, or offensive
Infringes on intellectual property rights
Contains malware or harmful code
Violates the privacy of others
Is spam or misleading

5. Privacy and Data

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

6. Subscription and Payments

JourneyPic offers a free tier and an optional paid subscription (JourneyPic Pro).

6.1 Free Tier

The free tier includes:

Unlimited journey creation
500 MB cloud storage for photos (sufficient for 1,000+ photos)
Unlimited video exports (with JourneyPic outro watermark)
Standard quality video export (up to 1080p)
5 bundled background music tracks
AI title generation (1 free use per journey)
AI itinerary summary (preview only)
Cutout people and avatar people (up to 2 people)
Collaborators (up to 2 per journey)
Offline cache (up to 2 journeys)
Default 3D model color
Footprint sharing (with JourneyPic branding)

6.2 JourneyPic Pro

JourneyPic Pro is an auto-renewable subscription that unlocks:

Unlimited cloud storage for photos (up to 125,000 photos per account under fair use policy)
Remove outro watermark from video exports
4K video export
16 premium background music tracks
Unlimited AI title generation and full AI itinerary summaries
AI-powered journal travel book generation
Cloud rendering via personal Mac server
Unlimited cutout people and avatar people
Unlimited collaborators per journey
Full offline cache (up to 50 journeys)
All 3D model color variants
Footprint sharing without branding
Pro map styles
PDF travel book export

6.3 Billing Terms

A 14-day free trial is available for new subscribers.
Payment is charged to your Apple ID account at confirmation of purchase.
Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period.
You can manage and cancel subscriptions in your Apple ID Account Settings.
Any unused portion of a free trial period will be forfeited when you purchase a subscription.
Refunds are handled according to Apple's refund policy.
Promotional pricing may be offered from time to time and is subject to specific terms disclosed at the time of offer.

7. Account Deletion

You may delete your account at any time through the app settings. Upon deletion:

Your account will be deactivated immediately.
You have 14 days to restore your account by logging back in.
After 14 days, permanent deletion begins and all your journeys, photos, GPS tracks, and personal data will be permanently deleted.
Your username may become available for others to use.
Active subscriptions should be cancelled separately through Apple.
Once permanent deletion begins, this action cannot be undone.

8. Prohibited Activities

You agree not to:

Use the App for any illegal purpose
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Scrape or collect data from the App without permission
Impersonate another person or entity
Use the App to harass or harm others
Use the Service for bulk or automated file storage unrelated to travel journeys

9. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by JourneyPic and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our written permission.

3D Models & Music

3D Models: The 3D vehicle models (USDZ files) included in the App are licensed assets used under their respective licenses (Creative Commons or commercial). You may not extract, copy, or redistribute these 3D model files.
Custom 3D Characters (Pro): When you create a custom 3D character, your uploaded photo is sent to third-party AI services (Google Gemini and Meshy AI) for processing. The uploaded photo and generated 3D model are stored on our cloud servers (Cloudflare R2) to enable cross-device synchronization — your custom models are automatically restored when you sign in on a new device. You retain ownership of your original photo. The generated 3D model is licensed to you for personal use within JourneyPic. You may not extract or redistribute the generated 3D model files outside of JourneyPic. When you delete a custom model, all associated cloud data (model file and metadata) is also deleted.
Background Music (BGM): All music tracks (both free and Pro tier) are licensed exclusively for use within JourneyPic video exports. You may use exported videos containing BGM for personal and social media sharing, but you may not extract, redistribute, or use the music tracks separately outside of JourneyPic exports.
Video Exports: Videos you create using the App belong to you. You are free to share, post, and use your exported journey videos for any personal or non-commercial purpose.
Journal Travel Book: AI-generated text content in travel books (spot descriptions, diary entries, quotes) is generated for your personal use. You own the exported PDF and may share it freely.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ALL TIMES. YOUR USE OF THE APP IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JOURNEYPIC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. This includes but is not limited to loss of data, GPS inaccuracies, service interruptions, and third-party service failures.

12. Indemnification

You agree to indemnify and hold harmless JourneyPic and its affiliates from any claims, damages, or expenses arising from your use of the service, your violation of these terms, your violation of any third-party rights, or content you upload or share.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes through the App or by email. Your continued use of the App after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by the laws of Hong Kong SAR. Any disputes shall be resolved in the courts of Hong Kong SAR.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and JourneyPic regarding the use of the service.
